Takže najprv všeobecne ohľadom bezpodielového spoluvlastníctva manželov (BSM):

BSM zaniká zánikom manželstva, v tomto prípade rozvodom.

Ak zanikne BSM, vykoná sa vyporiadanie.

Prvá možnosť je vyporiadanie dohodou. Ak sa nevykoná dohodou, vykoná ho NA NÁVRH niektorého z manželov súd.

Ak do troch rokov od zániku bezpodielového spoluvlastníctva manželov nedošlo k jeho vyporiadaniu dohodou alebo ak bezpodielové spoluvlastníctvo manželov nebolo na návrh podaný do troch rokov od jeho zániku vyporiadané rozhodnutím súdu, platí, pokiaľ ide o hnuteľné veci, že sa manželia vyporiadali podľa stavu, v akom každý z nich veci z bezpodielového spoluvlastníctva pre potrebu svoju, svojej rodiny a domácnosti výlučne ako vlastník užíva. O ostatných hnuteľných veciach a o nehnuteľných veciach platí, že sú v podielovom spoluvlastníctve a že podiely oboch spoluvlastníkov sú rovnaké. To isté platí primerane o ostatných majetkových právach, ktoré sú pre manželov spoločné.

Ako som už spomínal v predošlej odpovedi, všetko nasvedčuje tomu, že pri prevode podielu v bytovom družstve počas manželstva, vznikol (zo zákona) spoločný nájom bytu manželmi bez ohľadu na to, či sa manžel priznal, že je ženatý. Preto to vyzerá okrem zlyhania manžela aj na pochybenie úradov a bolo by vhodné túto skutočnosť doložiť (napr. sobášny list, na ktorom je dátum skorší ako dátum prevodu podielu v bytovom družstve).

Tým pádom by ste mali práva nájomcu, vrátane práva na vyporiadanie spoločného nájmu- či už dohodou alebo návrhom súdu (podľa § 705 OZ) . Aj v prípade, že by súd rozhodol, že právo užívať byt naďalej ako nájomca má bývalý manžel, máte právo na náhradné ubytovanie alebo prípadne aj na náhradný byt ( § 712a ods. 7 OZ).

Netreba ale zabúdať na to, že aj samotný podiel v bytovom družstve by bol predmetom vyporiadania BSM a ak sa nedospelo k dohode alebo nebolo rozhodnuté súdom do troch rokov od zániku manželstva, stáva sa tento podiel predmetom podielového spoluvlastníctva.
